Waiver of Liability for Attendees of  In-Person Services and Programming

Please note, this is NOT the form to agree to this waiver, but a disclosure of the language, to which you will be asked to agree no more than 24 hours before the service or program for which you have registered.


In order to attend, usher, lead, or staff any in-person service or program at Kane Street Synagogue, those who will be present on the premises must affirm their agreement to the following:


ACKNOWLEDGMENT, RELEASE, AND HOLD HARMLESS AGREEMENT

In consideration for receiving permission to be on the premises at Congregation Baith Israel Anshei Emes, also known as Kane Street Synagogue (“KSS”), located at 236 Kane Street, Brooklyn NY 11231, and to attend in-person religious services or other programming (“Services and Programming”), I, on behalf of myself, members of my household, and my minor child/ren, if applicable, hereby acknowledge and agree to the following:

  1. I understand the hazards of the novel coronavirus (“COVID-19”) and am familiar with the Centers for Disease Control and Prevention (“CDC”) guidelines regarding COVID-19.

  2. I have been advised and understand that attending in-person religious services or other programming exposes me to a risk of serious illness or death from COVID-19, or complications thereof. Notwithstanding the risks associated with COVID-19, I hereby willingly choose to attend and participate in the Services and Programming, and to fully assume the risk of illness or death related to COVID-19 arising from my being on the premises at KSS and participating in such activities.
     
  3. I further understand and agree that in order to attend Services and Programming at KSS, I am required to and must follow all rules of conduct established by KSS, including without limitation submitting to a health screening, and adhering to all applicable directions as further explained in e-mails, onsite direction, and signage posted at KSS.
     
  4. I hereby forever release, exculpate, discharge, indemnify, hold harmless, covenant not to sue, and waive any and all claims and causes of action whatsoever, whether known or unknown, contingent or fixed, liquidated or unliquidated, against KSS, and each of its officers, trustees, employees, agents, consultants, members, volunteers, and assigns (collectively, the “Releasees”), whenever arising, whether now or in the future, based on, related to or arising in connection with attendance or participation in Services and Programming, and/or the contraction of or exposure to COVID-19; provided however that this release shall not release the Releasees from any claim arising from KSS’s willful misconduct. 
     
  5. I acknowledge that this Acknowledgment, Release, and Hold Harmless Agreement (“Agreement”) is a material inducement to the permission granted by the Releasees to be on the premises at KSS and to participate in the Services and Programming.
     
  6. It is my express intent that this Agreement shall bind all members of my household, my minor child/ren, and any assigns and representatives, including my estate. I have informed my non-minor members of my household of this Agreement and have received their consent and agreement to the terms hereto. This Agreement may not be amended, modified or changed except in a writing signed by the President of KSS and there shall be no oral or implied waivers hereof.
